1. Acceptance of Terms
By accessing or using Asma (asma.nyx-intelligence.com), operated by Nyx Intelligence, the trading name of Arthur Dimeglio, a sole proprietor (entrepreneur individuel) registered in France ("Nyx Intelligence", "we"), you agree to be bound by these Terms of Service. If you do not agree, do not use Asma.
2. What Asma Is
Asma is an AI investing assistant that analyzes markets and can place trades on your own connected broker account, sized to your risk profile, at your discretion and risk.
- Analyzes markets and generates signals anchored in public data
- Places trades on the broker account you connect, when you authorize it
- Tracks your portfolio and sizes positions to the risk profile you set
- Reports on activity and performance
3. Accounts
You must create an account to use Asma. You are responsible for all activity under your account and for keeping your credentials secure. You must provide accurate information and be at least 16 years old.
4. Subscriptions & Billing
- Paid plans are billed in advance on a recurring basis (monthly or annual) via Stripe.
- Subscriptions renew automatically until cancelled. You can cancel at any time; access continues until the end of the current billing period.
- Except where required by law, fees already paid are non-refundable.
- We may change pricing with reasonable prior notice; changes apply to the next billing period.
5. Acceptable Use
You agree NOT to:
- Use Asma in violation of any applicable law or regulation
- Use Asma to plan, facilitate, or support any act of violence, harassment, or illegal activity
- Scrape, crawl, or automatically extract content beyond published API rate limits
- Attempt to reverse-engineer the agent or its underlying models and algorithms
- Redistribute, resell, or sublicense Asma outputs or data without written authorization
- Use Asma for market manipulation, insider trading, or any unlawful trading activity
- Treat Asma outputs as a personal investment recommendation or financial advice
6. AI Outputs & No Professional Advice
Asma generates automated outputs that may contain errors, omissions, or delays. Outputs are provided for information only and are not professional advice.
Asma does not provide financial, investment, tax, or legal advice and is not a registered investment adviser or broker-dealer. It does not guarantee any return. Trades are executed on your own broker account, at your own discretion and risk.
Investing involves risk, including the possible loss of principal. Past performance does not indicate future results. You are solely responsible for your investment decisions and for understanding the products you trade.
7. Third-Party Platforms
Asma connects to third-party brokers and market-data providers using credentials or API keys you provide. Your use of those services is governed by their own terms, and they may change their APIs, fees, or revoke access at any time. We are not responsible for the execution, availability, accuracy, or actions of third-party brokers or data providers, including order fills, slippage, latency, or outages.
8. Intellectual Property
All proprietary content, including Asma, its prompts, models, UI design, and visualizations, is owned by Nyx Intelligence. Content you provide or connect remains yours; you grant us a limited licence to process it solely to operate the service for you. Outputs generated for you are yours to use, subject to these Terms and any third-party platform rules.
9. Privacy
Your use of Asma is also governed by our Privacy Policy.
10. Disclaimer of Warranties
Asma is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.
11. Limitation of Liability
To the maximum extent permitted by law, Nyx Intelligence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Asma, including loss of profits, data, or business opportunities. Our total aggregate liability shall not exceed the amount you paid us in the twelve months preceding the claim.
12. Termination
You may stop using Asma and close your account at any time. We may suspend or terminate access for breach of these Terms or to comply with the law. On termination, your data is handled as described in the Privacy Policy.
13. Governing Law
These Terms are governed by French law. Any dispute relating to them shall be submitted to the competent French courts, without prejudice to mandatory consumer-protection rules of your country of residence.
14. Changes to Terms
We reserve the right to modify these Terms. Material changes will be notified in-app or by email; continued use after changes constitutes acceptance of the modified Terms.
